1. Acceptance
By downloading, installing, or using the Hard Rock Collector iOS app (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old, or the minimum age required by Sign in with Apple in your region, whichever is higher. By using the App, you represent that you meet this requirement and that you have a valid Apple ID.
3. License to use the App
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and run the App on Apple devices you own or control, for your personal, non-commercial use. The App is licensed, not sold. All rights not expressly granted are reserved.
4. User conduct
You agree not to:
- Falsify, spoof, or manipulate your device location to record a check-in you didn't physically perform.
- Use automated tools, bots, or scripts to interact with the App or our backend.
- Scrape, copy, or redistribute the café catalog, leaderboards, or other content for any purpose beyond personal use.
- Probe, test, or attempt to circumvent the security of the App or its backend, including rate limits and anti-cheat checks.
- Use a display name that impersonates another person, contains slurs or harassment, infringes a trademark, or includes content unlawful under the laws of your country.
- Use the App to harass, threaten, or stalk other users.
- Use the App in violation of any applicable law or regulation.
5. Subscriptions & payments
Some features may require a paid subscription ("Collector Plus"). Subscriptions are sold and processed by Apple through your Apple ID and renew automatically until you cancel them. You can cancel or change your subscription tier any time in iOS Settings → Apple ID → Subscriptions.
Refunds are handled exclusively by Apple via reportaproblem.apple.com. We cannot issue refunds directly. Cancellation takes effect at the end of the current billing period; no pro-rated refunds are provided.
6. Account suspension & termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms - in particular sections 4 and 7 - or if required by law. You may terminate your account at any time by using Settings → Delete Account inside the App; this deletes your data immediately and irreversibly.
7. Intellectual property & trademarks
The App is an independent fan project. It is not affiliated with, endorsed by, or sponsored by Hard Rock International ("HRI"). All names, logos, trademarks, and trade dress associated with "Hard Rock Cafe", "Hard Rock Hotel", or HRI's other brands are the property of their respective owners. We claim no rights in those marks. The App deliberately avoids reproducing HRI's official logos, color palettes, typography, and visual identity, and uses an independent design language inspired only by the broader rock, travel, and lounge genre.
The App's own source code, design system, original artwork (including the app icon used as our project mark), backend, and catalog structure are owned by the project contributors and licensed to you only under these Terms. You may not copy, modify, distribute, sell, or sublicense any portion of the App except where permitted by law.
8. User-generated content
You retain ownership of any content you submit (display name, friend lists, check-ins). By submitting it, you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, transmit, and display that content solely for the purpose of operating the App (for example: showing your name on a leaderboard your friends can see). The license ends when you delete the content or your account, except for backups that age out within a reasonable period and references that other users have already saved (such as a friend who saw your check-in in their feed).
9. Disclaimers
The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure against attack, or that all data (including café locations, opening status, or coordinates) is accurate or current. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our warranties are limited to the minimum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event will the project contributors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the App. Our total aggregate liability for any claim arising out of or related to these Terms or the App will not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim or (b) USD 20.
Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless the project contributors from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the App, or your violation of any third-party right.
12. Governing law & venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. Any dispute will be brought exclusively in the competent courts of Germany, unless mandatory consumer-protection laws of your country of residence give you the right to bring proceedings in your local courts.
13. Changes to these terms
We may update these Terms as the App evolves. Material changes will be announced in-app, and the "Effective date" below will be updated. Continued use of the App after the effective date means you accept the revised Terms.
