Apple's Standard EULA
The base terms governing your license to use the Hard Rock Collector iOS app (the "Licensed Application") are Apple's Standard Licensed Application End User License Agreement (the "Apple EULA"). By installing or using the Licensed Application, you agree to be bound by the Apple EULA as the agreement between you and us (the "Application Provider") with respect to the Licensed Application.
The Apple EULA covers, among other things:
- Scope of the license you receive (personal, limited, non-transferable, restricted to Apple devices you own or control).
- Maintenance and support - provided by us, not Apple.
- Warranty - provided by us; Apple is not responsible.
- Product claims - between you and us, not Apple.
- Apple as third-party beneficiary, with the right to enforce the EULA against you.
- Intellectual property rights, legal compliance, and export restrictions.
The provisions below supplement the Apple EULA. Where this document and the Apple EULA conflict, the stricter provision applies to the extent permitted by law.
Project-specific additions
1. Unofficial fan project
The Licensed Application is an independent, non-commercial fan project. It is not affiliated with, endorsed by, or sponsored by Hard Rock International ("HRI"). All trademarks associated with HRI's brands belong to their respective owners. The Licensed Application uses no official HRI logos or trade dress.
2. Prohibited use
You agree not to:
- Spoof or falsify your device location to record a check-in you did not physically perform.
- Use the Licensed Application or its backend services with bots, scripts, scrapers, or other automated agents.
- Probe, test, or attempt to bypass anti-cheat checks, rate limits, or other security mechanisms.
- Use the Licensed Application for any commercial purpose without our prior written consent.
- Reverse-engineer, decompile, or disassemble the Licensed Application except to the extent applicable law expressly permits.
3. Third-party services
The Licensed Application communicates with our backend, which is hosted by Railway in the United States, and uses Apple services (Sign in with Apple, APNs push notifications, and the App Store for any in-app purchases). Your use of those services is also governed by the respective provider's terms.
4. Subscriptions
Any in-app subscription (e.g., "Collector Plus") is sold and billed by Apple through your Apple ID, renews automatically until cancelled, and is governed by Apple's standard subscription terms. Manage or cancel a subscription in iOS Settings → Apple ID → Subscriptions. Refunds are issued exclusively by Apple via reportaproblem.apple.com.
5. Termination
This license terminates automatically if you breach any of its terms. You may also terminate it at any time by deleting the Licensed Application from all your devices and deleting your account inside the App. On termination you must stop using the Licensed Application; provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability) survive termination.
6. Disclaimer of warranty & limitation of liability
The Licensed Application is provided "AS IS", without warranty of any kind. To the maximum extent permitted by law, the Application Provider's total liability for any claim arising out of or related to the Licensed Application is limited as described in our Terms of Service §10. Nothing in this EULA limits liability for fraud, willful misconduct, or any liability that cannot be excluded by law.
7. Privacy
Our handling of your personal data is described in the Privacy Policy, which is incorporated by reference into this EULA.
8. Governing law
This EULA is governed by the law specified in the Terms of Service §12.
